We inform you that our company conducts sales through the webshop according to the General Terms and Conditions (hereinafter: GTC) set out below. By finalizing the order, the following GTC become part of the contract between the Buyer and the Seller.
Please kindly read the following document carefully.

According to Section 1 (1) of Act LXXVI of 1999 on Copyright (hereinafter: Copyright Act), the website qualifies as a copyrighted work, and all its parts are protected by copyright.
According to Section 16 (1) of the Copyright Act, unauthorized use of the graphical and software solutions, computer programs found on the website, or any application that modifies the website or any part of it is prohibited.
Any material taken from the website and its database may only be used with the written consent of the rights holder and must include a reference to the website and source citation.

Definitions
Parties: Seller and Buyer jointly
Consumer: a natural person acting outside the scope of their profession, independent occupation, or business activity. In these GTC, the special rules relating to the Consumer apply exclusively to this group of buyers.
Buyer: the natural or legal person, or organization without legal personality, who concludes a contract with the Seller through the Website.
The purchase price of the product: the price of the movable item, excluding shipping costs and fees
Total amount: the purchase price of the product(s) increased by the shipping cost.
Consumer contract: a contract where one party qualifies as a consumer
Website: this website, which serves for concluding the contract
Warranty: the mandatory warranty defined by Act V of 2013 on the Civil Code (hereinafter referred to as the "Ptk.") and in separate legislation for consumer contracts.
Distance contract: a consumer contract concluded within a distance selling system organized for the provision of the product or service under the contract, where the parties conclude the contract without their simultaneous physical presence, using exclusively means that allow communication between parties not present together.
Product: any tangible movable item offered for sale on the Website, which is the subject of the Contract.
Entrepreneur: a person acting within their profession, independent occupation, or business activity.
Contract language, contract form
The language of contracts covered by these Terms and Conditions is Hungarian.
Contracts covered by these Terms and Conditions are not considered written contracts and are not registered by the Seller.
Operation of digital content, technical protection measures
The availability of the servers providing the data displayed on the website exceeds 99% annually. Daily backups are made of the entire website data content, allowing restoration of the original data.
The data displayed on the website is stored in a MySQL database. Server devices and measures protect personal data and business secrets.
Information on the essential properties of the products
On the website, detailed information about the essential properties of the products available for purchase is provided in the descriptions of each product.
Purchase prices and sales tax
The webshop lists product prices in Hungarian forints, which include 27% VAT.
The Seller is entitled to modify the prices of products offered in the webshop. Price modifications do not apply to products already ordered.
In the case of an obviously incorrect price – which significantly deviates from the product's well-known, generally accepted, or estimated price – the Seller is not obliged to deliver the product at the incorrect price. (An obviously incorrect price is especially considered to be: a product price listed below 1,000 HUF or, in the case of a discount, the displayed discounted price if subtracting the discount percentage from the original price does not result in the displayed discounted price.)
After recognizing the error, the Seller will immediately contact the Buyer and offer the possibility to purchase the product at the correct price. With this information, the Buyer can decide whether to order the product at the correct price or withdraw from the contract without any adverse legal consequences. Any amount already paid will be promptly refunded to the Buyer. If the Buyer still wishes to purchase the product afterward, they can do so by sending an email to the Seller or placing a new webshop order. The amount already paid will be credited towards the purchase price.
The purchasing process
The Buyer can place an order (offer) in the Webshop at any time.
Selecting a Product
By clicking on the product categories on the website, you can select the desired product family and individual products within it. Clicking on individual products shows the product photo, description, and price. Products are illustrated with photos. The Buyer must pay the price listed on the website when purchasing. Please note that we do not take responsibility for any typographical errors or incorrect information!
Adding to Cart
After selecting a product, the Buyer can add any number of products to the cart by clicking the "Add to Cart" button without incurring any purchase or payment obligation, as adding to the cart does not constitute an offer.
The contents of the Cart can be freely modified until the order is finalized – until the "Pay" button is pressed – products can be removed from the cart at will, new products can be added, and the desired quantity of products can be changed.
Viewing the Cart
During the use of the website, the Buyer can check the cart contents at any time by clicking the "Cart" icon at the top of the page. Here, they can remove selected products from the cart or change the quantity of products.
If the Buyer does not wish to select and add more products to the cart, they must declare acceptance of the Terms and Conditions and acknowledgment of the Privacy Policy by checking the checkbox. Only then can they continue the purchase by pressing the "Proceed to Checkout" button. If they wish to continue shopping, they should select the "Continue Shopping" button.
Providing Customer Data
After pressing the "Cart" button, the contents of the cart appear, along with the total purchase price payable by the Buyer for the selected products. In the cart, by clicking the "Proceed to Checkout" button, the Buyer can fill in personal data if not yet registered, or log into our system by clicking the "Login" button. In the "Shipping Methods" box, the Buyer must indicate whether they wish to pick up the ordered product in person ("Personal Pickup") or request home delivery by courier. Shipping is only possible to addresses in Hungary. In case of delivery, the system indicates the shipping fee, which the Buyer is obliged to pay upon ordering. If the cart contents reach 25,000 forints, the shipping cost will be waived.
Correction of data entry errors – Responsibility for the accuracy of the provided data: The Buyer has the continuous opportunity to modify the entered data before finalizing the order (using the back button in the browser opens the previous page, allowing corrections even if the next page has already been accessed).
Please note that the Buyer is responsible for the data provided. The Seller fulfills the order, invoices, and delivers the product based on the data given by the Buyer. The Buyer must bear all damages resulting from incorrect or inaccurate data entry. Please pay special attention to the accuracy of the provided data—especially the email address—and avoid filling the mailbox storage.
Discounts:
The following discounts can be applied when purchasing through the webshop:
- Loyalty discounts are subject to the conditions found under Purchase Information\Loyalty Information.
- Individual discounts: coupons issued by Etyeki Kúria Kft. can be used within their validity period.
Please note that using courier services (GLS/MPL Post Package/Sameday) incurs an additional fee (hereinafter: shipping cost), which is charged on top of the product price. Shipping conditions can be found under Purchase Information\Shipping Information.
Finalizing the order (making an offer)
Please make sure that the contents of the cart match the products you wish to order and that your details are correct.
Payment terms and methods
a) Cash payment
If the Buyer chooses Cash payment during the order, the product can only be collected in person at the Seller’s wine bar located at Etyek, Báthori Street 21 (point of sale) on Tuesdays and Thursdays between 10:00 and 11:00.
If the Buyer does not collect the product within eight days from the pickup date recorded in the Order Confirmation, it shall be considered that the Buyer has withdrawn from the purchase.
The Seller may refuse further orders or deny fulfillment of the order paid in cash by a Buyer who has failed to collect the ordered product within the deadline specified in the confirmation.
b) Online payment
If the Buyer chooses online payment, the condition for finalizing and submitting the order is the prior online settlement of the purchase price and shipping cost (hereinafter: the Total Amount).
At the time of placing the order, the Buyer is required to pay the Total Amount by credit card through OTP Nyrt.'s Simplepay system. After entering the necessary credit card details, clicking the Pay button will execute the payment. The Simplepay system sends a direct notification upon successful payment.
By pressing the "Submit Order" button, the Buyer finalizes their order and sends it to the Notifier.
Modify or cancel order
In accordance with Act CVIII of 2001 on certain issues of electronic commerce services and information society services, the Seller's webshop software immediately sends a notification to the Buyer upon placing the order confirming receipt. The Buyer is entitled to withdraw or modify the order electronically within 24 hours of receiving this message.
Order processing, contract formation: Confirmation
The order and its confirmation are considered received by the Seller and the Buyer when they become accessible in their respective email systems.
The Seller will promptly confirm the receipt of the Buyer's order (offer) electronically. The contract is concluded when the confirmation email sent by the Seller becomes accessible in the Buyer's email system. After this, the Buyer can no longer withdraw the offer.
If the Buyer notices that the confirmation email contains incorrect data (e.g., name, delivery address, phone number, etc.), the Buyer is obliged to immediately notify the Seller by email, providing the correct information.
If the Buyer does not receive the confirmation email within 48 hours of placing the order, please check the storage capacity of your email inbox and the correctness of the provided email address, and contact the Seller.
If the confirmation is not received within 48 hours due to the above or other technical reasons, the Buyer is released from the offer obligation or contractual commitment.
The service provider responsible for delivery (hereinafter: GLS/Hungarian Post Plc.) will inform the Buyer by email about the expected delivery time (providing a time interval within one day).
Delivery deadline
The product is expected to arrive within 5-7 working days from the order confirmation.
Delivery and shipment of the ordered product
With reference to the "Detailed rules on the provision of postal services and postal services related to official documents, as well as the general terms and conditions of postal service providers and the consignments excluded or conditionally transportable from postal services" in Government Decree 335/2012 (XII. 4.) Section 3/A, the Seller allows the use of postal services provided by the universal postal service provider.
The Seller will notify the Buyer by email about handing over the ordered product to the courier service or, in case of personal pickup, about placing the product at the Seller's Wine Bar.
Regarding delivery, the Buyer can track the shipment according to the courier service chosen at https://gls-group.com/HU/hu/csomagkovetes/ or https://www.posta.hu/ugyfelszolgalat/nyomkovetes or the https://track.global/hu/courier/sameday-courier You can find information on the website.
The Buyer is obliged to ensure the receipt of the product during the period indicated by SMS or email by the GLS, Sameday, or MPL Postal Package courier service, according to the order. If the Buyer breaches this obligation, they must bear the resulting costs and compensate for damages.
If the Buyer does not collect the ordered product (except in the case of exercising the consumer’s right of withdrawal), the Buyer must bear the costs of return shipping. Please note that if you cannot be present at the specified collection place or time, notify the courier service or arrange for an authorized representative with written authorization.
The Seller’s right of withdrawal and refusal of performance
The Seller is entitled to refuse performance or withdraw from the contract within 24 hours of receiving the order confirmation if the product specified in the order is not available in the ordered quantity or if the Seller cannot deliver within the time frame specified in the “Delivery Deadline” chapter. The Seller must inform the Buyer by simple electronic mail sent to the email address provided during registration.
Retention of title and reservation of rights
The Total Amount (purchase price and shipping fee) remains the property of the Seller until full payment is made.
Methods of receipt, collection fees
Product delivery through the Seller’s partner responsible for shipping: the product is delivered to the home by GLS or MPL Postal Package. (see the Product Delivery chapter).
Personal collection of the product: if personal collection is chosen, the Buyer may collect the product at the Seller’s headquarters: 2091 Etyek, Báthori Street 21, during the opening hours of the Wine Bar, within 8 days following the notification of personal collection.
Partial Invalidity
If any provision of the GTC is invalid, incomplete, or defective, the remaining provisions of the contract shall remain in effect, and the invalid, incomplete, or defective part shall be replaced by the relevant legal provisions or the provisions reflecting the presumed intentions of the parties based on the regulation.
II. Special Provisions Applicable to Consumers
Consumer: a natural person acting outside the scope of their profession, independent occupation, or business activity Buyer
1. Protection of Children and Minors
According to Sections 16/A (1) and (4) of Act CLV of 1997 on Consumer Protection, ordered alcoholic beverages may only be received by persons who have reached the age of 18. The Seller or its representative is entitled to request credible proof of age from the consumer in case of doubt. If appropriate proof of age is not provided, the Seller is entitled to refuse the delivery of the ordered products. Delivery failure for this reason is considered unsuccessful delivery due to reasons attributable to the consumer, who is responsible for the consequences (e.g., the cost of re-delivery, etc.).
2. Right of Withdrawal
Referring to Section 20 of the Consumer Protection Act, the Seller provides the following information:
The consumer has the right to withdraw without justification if exercised within fourteen days from the day the consumer or a third party designated by them, other than the carrier, takes possession of the goods. The consumer may also exercise the right of withdrawal between the contract conclusion date and the goods receipt date.
The consumer may exercise the right of withdrawal by using the declaration form in Annex 2 or by sending a clear statement to the Seller in a verifiable manner.
The direct cost of returning the goods is borne by the Consumer.
The Seller also sells goods at the store located at 2091 Etyek, Báthori Street 21. If the consumer exercises the right of withdrawal at this store, they are entitled to return the goods to the Seller simultaneously.
If exercising the right of withdrawal, the Consumer must return the product immediately, but no later than fourteen days from the notification of withdrawal, unopened and undamaged, either by shipping or returning it to the Seller. The Consumer bears the cost of returning the product.
The Seller is obliged to refund the purchase price paid by the Consumer and the shipping costs immediately, but no later than 14 days after withdrawal. The Seller may withhold the purchase price until the Consumer returns the product unopened and undamaged.
Exclusion of the right of withdrawal: according to Government Decree 45/2014 (II. 26.) on detailed rules of contracts between consumers and businesses, the Buyer may not exercise the right of withdrawal for goods in sealed packaging that cannot be returned after opening for health or hygiene reasons. We inform consumers that our wine products are considered sealed packaging, so after opening, the consumer loses the right of withdrawal.
3. The consumer information about warranty, product warranty, and about the warranty
Warranty: If the Seller performs defectively, the Buyer may enforce warranty claims (replacement, price reduction, withdrawal) against the Seller according to the rules of the Civil Code. The Buyer is obliged to report the defect immediately after discovering it. The Buyer may switch from one warranty right to another, but the cost of switching shall be borne by the Buyer, except if it was justified or caused by the Seller.
Product warranty As a claim, the Buyer may only request the replacement of the defective product. The product is defective if it does not meet the quality requirements in effect at the time of marketing or if it does not have the properties described by the Seller.
Warranty: Due to the nature of our products, we do not provide a warranty.
The Seller does not have a code of conduct under the law prohibiting unfair commercial practices against consumers.

4. Complaint Handling and Legal Enforcement Options
The consumer may submit a complaint verbally or in writing to the Seller. The Consumer can raise consumer complaints related to the product or the Seller’s activities at the following contact details: Etyeki Kúria Kft. The Seller provides a substantive response to written complaints related to the order and delivery within 30 days. In case of rejection of the complaint, the Seller justifies its position.
If the Seller rejects the Consumer’s complaint, the Consumer is entitled to turn to the Conciliation Board competent according to their place of residence or stay: the condition for initiating the conciliation board procedure is that the consumer attempts to resolve the dispute directly with the concerned Seller.

We inform you that the Seller does not have a code of conduct under the law prohibiting unfair commercial practices against consumers.
III. Data Protection and Other Provisions
The Data Controller processes personal data in accordance with Act CXII of 2011 on the right of informational self-determination and freedom of information, REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL (April 27, 2016) on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, repealing Directive 95/46/EC (General Data Protection Regulation) – GDPR, as well as the provisions of Act CVIII of 2001 on electronic commerce services and certain issues related to information society services.
The Data Controller provides detailed information about data processing related to the webshop in the privacy policy available on the website.

The Contract is governed by the provisions of Hungarian law, and in particular the following laws apply:

CONSUMER INFORMATION
1. Warranty
In what cases can the consumer exercise their warranty rights?
In case of defective performance by the Seller, the consumer may enforce a warranty claim against the Seller according to the rules of the Civil Code.
What rights does the consumer have based on their warranty claim?
The consumer may exercise the following warranty claims at their choice:
- the consumer may request a replacement, except if this would cause disproportionate additional costs to the Seller,
- the consumer may request a price reduction or
- the consumer may withdraw from the contract: if the Seller did not undertake the replacement or cannot fulfill it within a reasonable time, or if the consumer’s interest in replacement has ceased, they may withdraw from the contract.
In the case of wine products, repair is conceptually excluded. You may switch from one chosen warranty right to another, but the consumer bears the cost of switching, except if it was justified or caused by the business.
Within what deadline can you enforce your warranty claim?
The consumer is obliged to notify the defect immediately after its discovery, but no later than within two months from the discovery of the defect. The consumer is responsible for any damage resulting from the delay in notification. The consumer can no longer enforce warranty rights after the two-year limitation period from the performance of the contract.
Against whom can the consumer enforce their warranty claim?
The consumer may enforce their warranty claim against the Seller.
What other conditions apply to enforcing your warranty rights?
In the case of a contract concluded with a consumer, a defect recognized by the consumer within six months following the performance shall be considered to have existed at the time of performance, unless this presumption is incompatible with the nature of the item or the nature of the defect. In the absence of this presumption or after its duration, the condition for enforcing the warranty claim is, in addition to notifying the defect and the contract with the Seller, proving that the defect already existed at the time of performance.
2. Product Warranty
In what cases can you exercise your product warranty rights?
In case of a defect in a movable item (hereinafter: product), the consumer may, at their choice, enforce either warranty rights or product liability claims according to the rules of the Civil Code.
What rights does the consumer have based on a product liability claim? As a product liability claim, the consumer may request the replacement of the defective product.
Against whom can the consumer enforce a product liability claim?
The consumer may exercise product liability rights against the product manufacturer or the Seller (hereinafter jointly: manufacturer).
When is a product considered defective?
The product is defective if it does not meet the quality requirements in effect at the time of marketing or if it does not have the properties described by the manufacturer.
Within what deadline can the consumer enforce a product liability claim?
The consumer may enforce a product liability claim within two years from the date the product was put on the market by the manufacturer. After this deadline, the right is lost.
What proof rules apply when enforcing a product liability claim?
When enforcing a product liability claim, the consumer must prove that the defect existed at the time the manufacturer put the product on the market.
In which cases is the manufacturer exempt from product liability?
The manufacturer is exempt from product liability if it can prove that – the product was not manufactured or marketed in the course of its business activity, or – the defect was not detectable according to the state of science and technology at the time of marketing, or – the defect results from the application of a legal or mandatory official regulation. The manufacturer only needs to prove one reason for exemption.
The consumer may enforce warranty claims against the Seller and product liability claims against the manufacturer simultaneously and in parallel for the same defect. If the product liability claim is successfully enforced, the consumer may thereafter only enforce the warranty claim for the replaced product against the manufacturer.
